Dysphagia Intervention Plan

1. About the Service

Dysphagia Intervention Plan is a web and mobile service for clinicians to create and manage dysphagia care plans and for patients to view plans assigned to them, record exercise completion, and communicate with their care team. These Terms apply to clinicians, clinic administrators, patients, and other people who use the service.

2. Accounts and Patient Use

You must provide accurate account information, protect your sign-in credentials, and promptly tell us if you believe your account has been used without permission. You may not access another person's account or patient plan except as authorized.

Clinicians and clinic administrators are responsible for having authority to enter and use patient information, for providing required notices and obtaining any permissions required for their use, and for managing their organization's users and access. Patients may use the service only for their own account and care plan, or through a parent or legally authorized representative where appropriate.

3. Clinical Decision-Making

The service is an administrative and clinical decision-support tool. It does not diagnose, treat, prevent, or cure a condition; replace a qualified clinician's judgment; or establish a clinician-patient relationship. Clinicians remain solely responsible for evaluating each patient, deciding whether and how to use recommendations, verifying information, and directing care. Patients should follow their clinician's instructions and contact a qualified healthcare professional with questions about their care.

The service is not an emergency service. Do not use it to request urgent medical help. For an emergency, contact local emergency services. Patients experiencing difficulty breathing or an immediate swallowing emergency should seek urgent medical care.

4. Subscriptions and Billing

Paid plans are billed monthly at the price shown at checkout. Unless canceled, a paid subscription renews for successive monthly billing periods. Payments are processed by Stripe. You authorize the applicable recurring charge when you subscribe.

You can manage or cancel a subscription through the account billing controls. Cancellation stops future renewals; the billing provider's confirmation will state when cancellation takes effect. We do not currently offer subscription pauses, prorated charges, or account credits. Nothing in these Terms limits refund rights that cannot lawfully be waived.

Plan features and usage limits are shown on the pricing page and may vary by plan. Taxes, if applicable, may be added by the payment provider. If payment fails or a subscription ends, paid features may become unavailable; clinicians and clinics remain responsible for retaining any records they need outside the service.

5. Acceptable Use

You may use the service only for lawful care-planning and related account administration. You must not use it to access data without authorization; violate another person's rights; interfere with or disrupt the service; attempt to bypass access controls; introduce malicious code; or use the service for unlawful, fraudulent, or unsafe purposes.

You must not rely on the service as the sole source for a clinical decision or enter information you are not authorized to disclose. We may investigate suspected misuse and restrict access as permitted by law and these Terms.

6. Your Content and Product Intellectual Property

You or your organization retain any rights you have in information and materials you submit. You grant Rebecca Henning a limited license to host, process, display, and transmit that content only as needed to provide, maintain, secure, and support the service, subject to the Privacy Policy and applicable law.

The service, its software, design, and materials are owned by Rebecca Henning or the applicable licensors and are protected by intellectual-property laws. These Terms give you a limited, revocable, non-transferable right to use the service for its intended purpose. No ownership rights are transferred to you.

7. Privacy and Service Availability

Our collection and use of information is described in the Privacy Policy. The service relies on third-party infrastructure and may be unavailable, delayed, or changed. We do not promise uninterrupted or error-free operation, and we may update or discontinue features with reasonable notice when practicable.

8. Suspension and Termination

You may stop using the service at any time and may request account deletion through the available account controls or by contacting us. We may suspend or terminate access for material violation of these Terms, security risks, legal requirements, or discontinuation of the service. Account closure does not necessarily immediately remove copies held in backups or records retained as required or permitted by law; see the Privacy Policy.

9. Disclaimers and Limits of Liability

To the maximum extent permitted by law, the service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. This does not exclude a warranty or right that applicable law does not allow us to exclude.

To the maximum extent permitted by law, Rebecca Henning will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, revenue, profits, or business arising from or related to the service. To the maximum extent permitted by law, total liability for claims relating to the service will not exceed the greater of the amounts you paid for the service in the 12 months before the event giving rise to the claim or US $100. These limits do not apply where prohibited by law.

10. Changes to These Terms

We may update these Terms. We will post the current version with its effective date. If a change materially affects your rights or obligations, we will provide notice through the service or to the email address associated with your account when practicable. Continued use after the new effective date means you accept the revised Terms; where renewed acceptance is required, we will ask you to accept before further use.

11. Governing Law and Contact

These Terms are governed by the laws of the State of Georgia and applicable federal law, without regard to conflict-of-law rules. Subject to any non-waivable rights, the state and federal courts located in Georgia will have exclusive jurisdiction over disputes relating to these Terms or the service.
